Arthur Kinoy, People's Lawyer Did he Succeed in Combining Law & Conscience - Essay Example And he was quite active in behalf f the Southern civil-rights movement f the 1960s. Together with partners William and Michael Kunstler, he helped form what they called the "people's KKK." In fact, his book Rights on Trial, a memoir f his exciting and turbulent career, is subtitled The Odyssey f a People's Lawyer. Kinoy argued before the Supreme Court six times, winning five f those appeals. The case he considered most significant was United States v. United States District Court, in which the Nixon Administration tried to defend Justice Department wiretapping f antiwar protesters without a warrant, on the grounds that the President had the "inherent power" to ignore individual constitutional rights if he thought national security was at stake. Kinoy helped establish the now-extinct Citizen's Party, and ran on its ticket for a New Jersey State Senate seat in 1981. He didn't come close to winning, but says the campaign was a successful organizing tool. Kinoy believed people's movements had made a lethal tactical error by not talking about "the conspiracy f the power elite" to eviscerate the Constitution. Whether in the courtroom or in a debate, Kinoy was a feisty and brilliant thinker who was as relentless as he was ingenious. Most f his autobiography makes it appear that he went through his life as lawyer never pretending to e objective, never less than totally convinced about the justness f the causes he represented and the innocence f his clients. That posture, however, gives rise to some other questions. Most f Kinoy's important cases - Dennis v. United States, the White Panthers case, the Julian and Anna Rosenberg case, the Adam Clayton Powell case, the Chicago Seven case - involved some f the most significant political events f this country's 20th century history. The causes represented some f the most serious rifts in the democracy f the United States. Given Kinoy's frank admission that he was not detached from the causes in which he was involved, one might wonder how good the lawyering is when the lawyer and the client are equally passionate about the political cause that gives rise to the case. How clearly can a passionately involved lawyer describe the workings f the judicial system when the judges and opposing layers are by definition part f a conspiracy against justice and truth Kinoy indeed dealt with some troublesome players - Roy Cohn f the McCarthy era, Judge Julius Hoffman in the Chicago Seven case and Judge Harold Medina in the Dennis case - but he also presented many cases to the Supreme Court and to other tribunals, and even he finds it hard to write off all his judges and opponents as enemies in the class struggle. So the book wavers between condemnation f a legal system that is a stocked deck and an enthusiasm for the judicial process that ultimately led to the vindication f Kinoy's clients (and position) in the Chicago Seven case f in the Adam Clayton Powell case. There is apparently no such wavering about the lawyering that stems from deep commitment to the "cause". It is passing strange that with all those high intensity cases, not once does Kinoy reflect on the legal tactics his side used. Perhaps that is asking too much,

Roel of Violence in Flatland        Some people turn to violence when something does not go          their way, or someone says something they do not agree with. It        does not take brains to solve a problem with your fists; it just makes  people look immature, and uneducated. Fighting and violence is         more prevalent at Bloomsburg than in many of the students home         towns. It seems that people are to busy or to drunk to just sit down  and talk things out like reasonable people.                                 Violence plays a major roll in the novel Flatland.  It seems like someone is always disagreeing with someone, and creating a  conflict, as when the square resorts to violence by sending his        hardest right angle into a violent collision with the stranger, only  because the square would not let himself be convinced of the           mysteries of Spaceland, or if an infant whose angle deviates by half a  degree from the correct angularity is summarily destroyed at birth.  If we destroyed all the mentally retarded people at birth because      they have flaws, and are not like everybody else, or if everyone       attacked people just because of something they said that we did not  believe--if this happened all the time, we would completely destroy  the world.                                                                    The college scene is really horrible when it comes to violence.  Members of fraternities and sororities are terrible at staying calm,  and controlling their temper, because of alcohol, and other drugs.     When a person drinks he becomes this monster of violence, a            fighting machine. People lose all senses of right and wrong when       they have the beer muscles on. A slight bump of the arm at a party     can trip the switch of a drunk, violent person. Even the weakest       person can experience this amazing feeling of power if she drinks      excessive amounts of alcohol. In small towns about the only            violence there is to see is in the bars, and taverns. Usually it is the  uneducated, lower-class people just blowing off a little steam. Life  in a small town is for the most part simple.

The Hot Zone
The Hot Zone is a factual story by Richard Preston about the outburst of the Ebola virus in a monkey house located in neighborhood of Reston, Virginia. In the first half of the book, the author tells about the previous outbreaks of Ebola-like viruses in the African continent and talks about the consequent disaster. He refers to the painful demise of a French expatriate, Charles Monet and several other effected by the disease. Major Nancy Jaax, a U. S. Army personal was called upon after the Reston outburst occurs.She works in full body â€Å"space suits’’ (Preston 1999) with the most deadly viruses with in laboratories known as â€Å"Hot Zones†(Preston 1999). Nancy Jaax, a housewife and a mother, tries to keep a balance between her job and family life though the former always gets priority. Her husband and colleague, Jerry Jaax gets worried about her vulnerable exposure to such dangerous agents at Fort Detrick. The monkeys kept under observation for Ebola virus testing in the research facility at Reston starts falling ill after a certain time.By examining their tissue samples, Nancy and her colleagues concluded the illness being caused by the virus. Hundreds of monkeys in the monkey house are killed by the military and the Centers for Disease Control in order to prevent the virus entering the human residents in the area. Strict precautionary measures are taken throughout the procedure. Finally, the entire building is decontaminated and the employees go back to their normal lives. In order to discover the origin of these viruses, a U.S scientific expedition visits a place in Kenya where some of the infected people were reportedly visiting the area. Unfortunately, the mission failed but the leading doctor of the expedition was able to put away the equipment used during the mission. The decontamination project at Reston was a success. As the story progresses, we learn about the disappearance of cigarettes from the factory and the police are out man-hunting those behind the crime. According to workers at the factory, they had witnessed a group of young boys break into the factory. The boy’s mother warns that they are likely to be captured and jailed if they didn’t own up their evil deeds. At the mention of this, the boy affirms that he was not part of the gang but Li whom he says that he was behind the whole idea of stealing cigarettes from the factory (Ying 52). After investigations, the culprits are captured and it turns out clearly that they did not steal cigarettes alone but everything else they laid their hands on. Similarly, Liu’s visit at the boy’s home ends up violently when they reach the pond site. Although he never read books, he claims to have come to borrow books. As they are walking towards the pond, Liu pushes the boy bullishly from behind, causing him to land on the muddy ground and have his clothes socked in water and books covered with mud (Ying 53). The boy responds by hitting him back although it is not enough to make him lose his stability. Towards the end of the story, Liu and Big Brother and caught by Public Security officers for being in possession of criminal evidence (Ying 61). They are taken in custody as the boy is lef t with the responsibility of taking care of their mother. They are tried and Big Brother is found guilty of serious crimes including suicide attempt. As a single man who wishes to marry in future, Big Brother understands that money was paramount for him to think of marriage. Poverty is further manifested through the kind of meals served. The boy’s mother serves him with soya beans without oil which she considers to be expensive. This illustrates the low quality of meals which the family survives on. Additionally, family members have to carry mats and bamboo beds outside after every dinner in order to allow houses to cool to reasonable temperatures to allow sleep (Ying 54). The description of this scenario depicts a case of poverty facing the society. The author notes that the boy’s mother had a close eye on him, monitoring his single move. In Romania, during 2003, the structure of the education system was, to an extent, hard to understand. The various schooling system consisted of pre-school education, primary school, lower secondary school, high school, vocational school, apprentice school, long-term higher education, short-term education, post secondary school, and post graduate school. Children entered pre-school education between the ages of three and six. At the age of six, the child entered primary education, which was the first four years of compulsory education. According to the 2003 amendment to the Education law, children entered school at the age of six. Once found only in health food stores, organic food is now a regular feature at most supermarkets. And that’s created a bit of a dilemma in the produce aisle. On one hand, you have a conventionally grown apple. On the other, you have one that’s organic. Both apples are firm, shiny and red. Both provide vitamins and fiber, and both are free of fat, sodium and cholesterol. Which should you choose? The word â€Å"organic†refers to the way farmers grow and process agricultural products, such as fruits, vegetables, grains, dairy products and meat. Organic farming practices are designed to encourage soil and water conservation and reduce pollution. Farmers who grow organic produce and meat don’t use conventional methods to fertilize, control weeds or prevent livestock disease. For example, rather than using chemical weedkillers, organic farmers may conduct more sophisticated crop rotations and spread mulch or manure to keep weeds at bay. The U. S. Department of Agriculture (USDA) has established an organic certification program that requires all organic foods to meet strict government standards. These standards regulate how such foods are grown, handled and processed. Any product labeled as organic must be USDA certified. Only producers who sell less than $5,000 a year in organic foods are exempt from this certification; however, they’re still required to follow the USDA’s standards for organic foods. If a food bears a USDA Organic label, it means it’s produced and processed according to the USDA standards. The seal is voluntary, but many organic producers use it. Products certified 95 percent or more organic display this USDA seal. Products that are completely organic  such as fruits, vegetables, eggs or other single-ingredient foods  are labeled 100 percent organic and can carry the USDA seal. Foods that have more than one ingredient, such as breakfast cereal, can use the USDA organic seal plus the following wording, depending on the number of organic ingredients. Products that contain at least 70 percent organic ingredients may say â€Å"made with organic ingredients†on the label, but may not use the seal. Foods containing less than 70 percent organic ingredients can’t use the seal or the word â€Å"organic†on their product labels. They can include the organic items in their ingredient list, however. Natural and organic are not interchangeable terms. You may see â€Å"natural†and other terms such as â€Å"all natural,†â€Å"free-range†or â€Å"hormone-free†on food labels. Criminal law intimidates citizens because most people won’t want to be arrested or have a write up on their personal record. Criminal law controls behaviour but only outlines what a good citizen should be doing, by creating laws. â€Å"More precisely, the term refers to substantive criminal law – a body of law that prohibits certain kinds of conduct and imposes sanctions for unlawful behaviour.†(The Canadian Encyclopedia, Criminal Law, http://www.thecanadianencyclopedia.com/articles/criminal-law, para. 1.) Having laws and not enforcing them is pointless, so by creating a law you need to enforce it strictly so people stop committing the offence. Like in Alberta and other parts of Canada the Distracted Driving law was in full effect and anyone caught texting and driving or anything along those lines was given a major demerit dock, and a hefty ticket you need to pay. By doing this it enforces the law and creates that thought in the back of the citizens head that says â€Å"should I do that? What will happen if I text and drive and get caught?†. However, most criminals don’t have that subconscious thought and don’t care if they get caught breaking the law, that’s why so many criminals are re-offenders. Laws are either questions concerning criminal justice and safety too restrictive or not restrictive enough depending on where you live. Some people can be considered criminals in Canada, but be doing family honour killings in their homeland. Having pretty much non existent drinking ages in Europe to the United States where you have to be 21 is absolutely unreasonable, and depending on where you live your laws can either be too restrictive, like in the US, or not restrictive at all, in Europe. There should be a universal drinking age of 16, and the driving age should be raised. Allowing teenagers and young adults to drive before they learn the effects of drinking is not a good policy. Too many citizens think because they have been driving for 2 – 4 years think that they can drive drunk which is not the case and creates a big problem. Among 18 – 24 year olds, they have the highest percentage in Canada for driving under the influence per 100,000 licensed patrons. Universally, if you lowered the drinking age and heightened the driving age to 21, hopefully less people would be drinking and driving because more people would have experienced the effect of alcohol before driving. If this actually worked then maybe less and less police officers would need to worry about check stops and be less restrictive on certain laws and would be able to focus on other important things around Canada. questions concerning criminal justice and safety ii. Assuming that males are more violent than females; does that mean that crime has a biological rather than a social basis (because males & females share a similar environment)? Statistically males made up for more then five times the amount of crime then females did in 2005. Males aren’t biologically programmed to be more physically aggressive and commit more crimes, but when people say males commit more crimes because of testosterone, that is crazy because women have testosterone in their body’s too. Males commit more crimes because most males want to assert their â€Å"macho – ness†to females and prove that they are manly. When males are 20-25 years old, the highest category for committing a crime, they have no other ways to show females how manly they are other then fighting and committing crimes. I think the reason why older males don’t commit more crimes compared to the younger generation is because older folk have other ways to show their manliness like their job, how much money they have, or the kind of car that they drive. That being said crime has nothing to do with biology, but it comes down to men trying to show how powerful they are in an attempt to â€Å"woo†a female. Concerning the fact that males and females sharing the same environment but males being â€Å"more violent†, I think the reason is because males aren’t as protected as females are. During high school kids always hear about fathers or brothers who will protect their child or sibling from anyone that hurts them in any way. School can be a very dangerous place for teenagers depending on the area of town that they live in. In Calgary high schools are more safe down south then in Forrest Lawn just because of the type of families and people there are around influencing the teenagers. At the Columbine shootings two teenagers shot and killed many innocent teenagers, in Michael Moores documentary it is shown that the two students were bullied occasionally which may have caused them to act out and shoot their peers. Around schools you have teachers and counsellors supervising you and helping you throughout your 3 years so it can’t be as dangerous as people make it out to be. However the activities that take place outside of school I think are the most violent ones. They involve students and peers that you’ve met through high school and I believe people are getting those two things mixed up, but that’s just from personal experience because inside of my high school was relatively safe. We had a lockdown where a student from another school came into ours with a knife looking for a student in one of the classes but the police came and handled the situation accordingly and our teachers were well prepared questions concerning criminal justice and safety and practiced lockdowns on a regular basis. Later we all found out this situation happened because of activity outside of school. My personal experiences in high school I never had a physical altercation with anyone but in grades 10 and 11 a lot of students would make organized fights after school and a big crowd would join. I think this relates to the previous question on men being more violent, because teenagers have no other way to assert their manliness to friends and girls other then to fight and beat someone up. I think the most dangerous places in our rural communities is back alleys at night time walking home from drinking at a friends or at a bar. You make yourself an easy target being drunk and that’s when criminals take the chance to mug you. By being at school it’s really hard to make yourself a big target with teaching staff all around you. To sum everything up I do not agree that schools are the most dangerous place for young people.
